LITIGATION

Our attorneys handle a variety of litigation matters in state and federal courts, as well as before federal and state administrative agencies, including the New York State Department of Environmental Conservation (DEC), the Army Corps of Engineers and the Mine Safety and Health Administration (MSHA).

Our litigation experience generally involves complex environmental litigation, often involving defending or challenging compliance with the New York State Environmental Quality Review Act (SEQRA) in connection with project approvals or denials, and challenging other agency determinations through Article 78 proceedings. Our experience also includes litigation matters involving New York environmental laws, including the Navigation Law and the Mined Land Reclamation Law and federal environmental laws, such as the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and the Clean Water Act (CWA).     

In the administrative litigation context, our attorneys have represented clients in issues conferences and adjudicatory permit hearings before DEC, we have defended clients against environmental enforcement proceedings brought by the EPA, DEC, the Army Corps of Engineers and MSHA and we have defended clients against stop work orders and notices of violation issued by municipal governments.

We also have experience in general commercial litigation matters, including breach of contract actions and real property disputes.
